Rules differ by state, and your attorney can review what applies to your situation. A prenup can specify how dividends are treated regardless of the underlying share's acquisition date.
Does it matter that Intuit stock has declined recently?
Stock price changes affect the current value of your holdings but do not change the number of shares you hold or when they were granted. A prenup addresses ownership and categorization, not a specific price. Whether the stock is at a high or a low when you sign does not change the legal framework.
